1. Introduction
This Privacy Policy explains how personal information is collected, used, disclosed, and protected when you visit search.steinrealtygroup.ca(the "Site") operated on behalf of Brett Stein of Homewise Real Estate ("we," "us," or "our").
The Site provides real estate search tools, listing detail pages, market information, and ways to contact a licensed real estate professional. We are committed to handling personal information in a manner consistent with Canadian privacy law and the CREA Privacy Code followed by REALTORS®.
2. Who is responsible for your information
Data controller for inquiries you submit on this Site: Homewise Real Estate / Brett Stein is responsible for contact form submissions, showing requests, and client communications arising from this website.
Technology platform: The Site is powered by Valery Technologies Inc. (trade name "Homies"), which provides hosting, listing search infrastructure, authentication, email delivery, and CRM integrations on behalf of the real estate professional. Homies processes data as a service provider / processor to operate the Site and does not use your information for unrelated marketing.
MLS® boards and CREA impose separate rules on how listing data may be displayed; those requirements are described in our Terms of Service.
3. Applicable privacy laws
Depending on your location, this Policy is designed to align with:
- PIPEDA — Personal Information Protection and Electronic Documents Act (Canada), including the ten fair information principles in Schedule 1;
- CASL— Canada's Anti-Spam Legislation, for commercial electronic messages;
- Provincial privacy laws — including Quebec Law 25, British Columbia and Alberta PIPA, where applicable;
- CREA Privacy Code — principles adopted by members of the Canadian Real Estate Association;
- Provincial real estate legislation— including Ontario's Trust in Real Estate Services Act (TRESA) and the Real Estate Council of Ontario (RECO) rules where Brett Stein is licensed in Ontario.
4. MLS® listing data
Listing photographs, descriptions, prices, and related fields displayed on this Site are licensed from participating boards (TRREB) and CREA's data distribution framework. Coverage includes the Greater Toronto Area and surrounding municipalities served by the Toronto Regional Real Estate Board (TRREB) / PropTx.
Board rules require that listing brokerage names appear with listing content, that CREA trademarks be displayed, and that certain sold or historical data (VOW data) only be shown to registered users who have agreed to applicable terms. We apply these restrictions through account registration and listing permission flags.
We do not sell MLS® listing data. Scraping, bulk downloading, or re-publishing listing feeds without authorization is prohibited.
5. Information we collect
We may collect the following categories of personal information:
- Contact & identity — name, email address, phone number, and message content when you use our contact form, request a home evaluation, book a showing, or enquire about a listing;
- Consent records — whether you opted in to calls, emails, and text messages, including the exact consent language presented at the time of submission (required for SMS compliance);
- Account & verification — if you create an account to save favourites, view restricted listing details, or verify your phone number, we collect login credentials, profile information, and one-time passcodes sent via SMS;
- Property interests — listings you view, save, or enquire about; search queries; map areas browsed; and similar on-site activity used to improve your experience and notify your agent;
- Technical data — IP address, browser type, device identifiers, pages visited, referral URLs, and timestamps collected in server logs for security and performance;
- Cookies & local storage — session tokens, authentication state, and preference cookies (see below).
We collect only information that is reasonably necessary for the purposes identified in this Policy.
6. How we use information
We use personal information to:
- Respond to inquiries and provide real estate services;
- Contact you by phone, email, or SMS where you have provided express consent;
- Send listing alerts, market updates, or follow-ups you request or consent to receive;
- Operate search, map, favourites, and gated listing features;
- Sync leads and activity to the agent's CRM (customer relationship management) dashboard;
- Detect fraud, abuse, and security incidents;
- Comply with MLS® board rules and applicable law.
7. PIPEDA fair information principles
Consistent with PIPEDA and the CREA Privacy Code, we follow these principles:
- Accountability — Brett Stein is accountable for personal information under its control, including information processed by service providers;
- Identifying purposes — purposes are described in this Policy and at the point of collection (e.g., contact form);
- Consent — we obtain meaningful consent before collection and use, except where permitted or required by law;
- Limiting collection — we collect only what we need;
- Limiting use, disclosure & retention — information is used only for identified purposes and retained only as long as necessary;
- Accuracy — you may request corrections to your information;
- Safeguards — administrative, technical, and physical measures protect personal information;
- Openness — this Policy is publicly available;
- Individual access — you may request access to your personal information;
- Challenging compliance — you may contact us with privacy concerns.
8. Email, SMS & phone (CASL)
When you optionally check the consent box on our contact form, you give express consent to receive commercial electronic messages from Homewise Real Estate (represented by Brett Stein) about real estate services by call, email, and text.
If you submit the contact form without checking the box, we may still contact you to respond to your specific inquiry under CASL's implied consent rules for business inquiries (generally for up to six months). That does not authorize ongoing marketing messages — only follow-up related to your request.
Opt-out: Reply STOP to any text message to unsubscribe from SMS. Reply HELP for assistance. You may unsubscribe from marketing emails using the link in those messages. Message and data rates may apply. Message frequency may vary. You may withdraw consent at any time.
Mobile information: We do not sell or share mobile phone numbers, SMS opt-in data, or consent records with third parties or affiliates for their own marketing or promotional purposes. SMS opt-in data and consent are excluded from any data-sharing arrangements except as needed to deliver messages you requested (e.g., CRM or messaging providers acting on our behalf).
Transactional messages (e.g., account verification codes, responses to a specific inquiry you initiated) may still be sent as permitted by CASL even if you withdraw marketing consent.
11. Cross-border processing
Personal information may be processed or stored in Canada, the United States, or other jurisdictions where our service providers operate. When information is processed outside Canada, it may be subject to lawful access by foreign authorities. We require service providers to protect information with contractual and technical safeguards appropriate to the sensitivity of the data.
12. Retention
Contact submissions, account records, and CRM activity are retained for as long as needed to provide services, maintain business records, resolve disputes, and comply with regulatory requirements (including real estate record-keeping rules in Ontario). When information is no longer required, it is securely deleted or anonymized.
13. Security
We use industry-standard measures including encryption in transit (HTTPS), access controls, and service-provider security programs. No method of transmission or storage is 100% secure; please use strong passwords and protect your account credentials.
14. Your privacy rights
Subject to applicable law, you may have the right to:
- Request access to personal information we hold about you;
- Request correction of inaccurate or incomplete information;
- Withdraw consent to marketing communications (subject to legal or contractual restrictions);
- File a complaint with the Office of the Privacy Commissioner of Canada or your provincial privacy commissioner.
To make a request, contact us using the details in Section 17. We may need to verify your identity before responding.
15. Children's privacy
The Site is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us so we can delete it.
16. Changes to this policy
We may update this Privacy Policy to reflect changes in law, board rules, or Site features. The "Last updated" date at the top will change when we do. Material changes may be communicated on the Site. Continued use after changes constitutes acceptance of the updated Policy.
